A website at thehealthhealer.com.pk has copied our brand name and is publishing a page claiming to be the "official" Health Healer and accusing genuine sellers of being fake. Why "Class 44" does not allow online skincare sales
Trademark classes exist so two unrelated businesses can register the same or similar name without conflict, as long as they operate in different fields. Pakistan, like most countries, follows the international Nice Classification system. Two classes matter here:
Cosmetics & the goods themselves
Covers skincare creams, scrubs, face wash, cosmetic preparations — and the sale of those goods, including online retail. This is the class a skincare brand needs to legally manufacture, brand, and sell its own products through a website or store.
Medical, veterinary & beauty services
Covers professional services rendered to a person or animal — think salons, spas, clinics, dermatology consultations, grooming services. It does not cover manufacturing, branding, or retail sale of packaged cosmetic products.
In short: a Class 44 certificate would let its holder lawfully open a beauty salon under that name. It does not give them the right to manufacture skincare products, put a brand label on them, and sell them through an online store — which is a Class 3 activity. Presenting a Class 44 certificate as proof of the right to run an e-commerce skincare brand is, at best, a misreading of the certificate, and at worst, a deliberate attempt to mislead customers and search engines.
